Police violence, ICC and COVID-19

Over the past weeks, Palestinian citizens of Israel have been protesting against the systemic failures of Israeli police to deal with the surge in crime in their communities, and a deadly incident in the town of Tamra, where police killed a criminal suspect and a bystander.

Adalah issued a statement strongly condemning the Israeli police killing of 22-year-old nursing student Ahmad Hijazi, during their attempt to thwart criminal activity in Tamra. Adalah also filed an urgent motion to the Nazareth Magistrates’ Court demanding the cancellation of a gag order imposed on the investigation into these killings. Yesterday, 7 February 2021, the court decided that the gag order would expire, unless the police appealed the decision. Read more

Adalah also sent a letter on 4 February 2021 to Israel’s attorney general and national police commander demanding that they instruct officers to refrain from dispersing protests against police violence and crime taking place in Arab towns; to stop the excessive use of force against demonstrators, and to open roads to allow access to the protests. During the past several weeks, a number of protesters were wounded when Israeli police employed brutal force, including rubber-coated metal bullets, tear gas grenades, and batons during protests.

Israeli police violence is the result of systematic racism and incitement by the state, which perceives Palestinian citizens as enemies. Further, an Israeli police culture of impunity sends a dangerous message to officers that they will likely not be held accountable for their actions.

Throughout the protests, Adalah provided legal advice and assistance to individuals arrested or detained by Israeli police and demanded an investigation into the police’s violent conduct during the events. Read more

ICC: Landmark Decision on the Situation in Palestine

On 5 February 2021, the International Criminal Court (ICC) issued a decision on the “Situation in Palestine” ruling that it has jurisdiction over the Palestinian Territory (OPT): Gaza and the West Bank, including East Jerusalem. This decision opens the door for the ICC prosecutor to initiate a formal investigation into international crimes. Adalah welcomes the decision, which furthers the ICC’s mandate of ending impunity. Read the full decision by the ICC

In June 2020, Adalah issued a report challenging the Israeli attorney general’s position rejecting the ICC’s jurisdiction. Adalah’s findings led to the conclusion that the ICC must defend victims – particularly in Gaza – who have been left by Israel in a legal ‘black hole’ with no domestic legal recourse or remedy, civil or criminal. RECENT SUCCESSES: COVID-19 CASES

Expanding eligibility for COVID-19 food security grants

Following Adalah’s legal demands, in December 2020, Israel’s Interior Ministry revised its criteria for the distribution of COVID-19 food stamps, which will allow the greater inclusion of at-risk families, notably Bedouins living in unrecognized villages in the Naqab (Negev), and made more information about the program available in Arabic on its website.

Vaccinations for all prisoners

Following a petition to the Supreme Court filed by five human rights organizations, including Adalah, and led by Physicians for Human Rights-Israel, in January 2021 Israeli authorities started vaccinating all prisoners against COVID-19, including thousands of Palestinian prisoners.

Vaccinating Bedouin citizens in the Naqab

In response to a letter by Adalah in January 2021, the Clalit health maintenance organization confirmed that it was opening new vaccination centers in four villages, which would serve some 20,000 Bedouin residents. Adalah is continuing to demand that Clalit opens more clinics in the region to allow vaccinations for 100,000 Bedouins. There is a very low rate of vaccination in this community, due in large part to the lack of accessibility of health services.
