Adalah Petitions Supreme Court Asking Army and GSS to Reveal Location of Jenin Camp Detainee

Today, Adalah submitted a petition to the Supreme Court asking for a writ of habeas corpus on behalf of Jamal Mustafa Khueil, a resident of Jenin refugee camp who was detained by the Israeli army on 10 April 2002. The petition was filed by Adalah Staff Attorney Orna Kohn.

After his arrest, Mr. Khueil was held by the General Security Service (GSS) at the GSS Interrogation Unit of the Kishon Detention Centre (Jalameh) near Haifa. He was held there until 22 April 2002. From this date, Mr. Khueil's father could not obtain any information about where his son was being held. 

According to information given to Adalah by the Kishon Detention Centre, Mr. Khueil is still registered on the Detention Centre's detainee list as being held in the GSS Interrogation Unit. Detention Centre staff admitted, however, that on 24 April 2002 he was taken from the Centre by GSS investigators, who did not announce where they were taking him. He was not returned to Kishon Detention Centre. 

Adalah submitted a pre-petition to the Attorney General's office, demanding to know where Mr. Khueil is being held. The Attorney General's office refused to provide this information, but stated that he is being investigated at a GSS facility and that investigators from the Kishon GSS Interrogation Unit are taking part in the investigation. As of today, Adalah has not received a reply to its second letter to the Attorney General on this matter. 

In the petition, Adalah argued that the army and the GSS violated their duty to inform one of Mr. Khueil's relatives as to the place in which he is being held. This duty derives from the most fundamental rules of law, and is an integral part of the right to human dignity, protected by the Basic Law: Human Dignity and Liberty. This obligation is also specifically included in the military regulations governing the Israeli occuptation of the West Bank.
